On April 15, 2026, the Indian Patent Office (IPO) reinforced this by officially rejecting a landmark application that designated the AI system DABUS as an inventor. This decision confirms that under Sections 2(1)(p) and 6 of the Patents Act, the status of “true and first inventor” is strictly reserved for natural persons.

Furthermore, Section 3(k) of the Patents Act remains a significant hurdle. It excludes computer programs from patentability unless the applicant can demonstrate a substantial technical contribution or a technical effect that goes beyond the code itself. Okay, but there must be something in the prior art that cannot be used against an inventor, right?

So, what is not considered prior art?

Any information that is not published in a real substantial manner is not considered as prior art. For example, if someone knows some information in their mind and there is no proof of its existence, then it cannot be considered as prior art. Based on your business objective, you can pick for different patent searches:

1. If the inventor wants to understand the existing state of their invention and make better strategic IP decisions, landscape study or landscape search is what an inventor must go for.

In this study, patents and non-patent literature are analyzed. A landscape search provides a bird’s eye view of the technology. A complete landscape report consists of patent references and other technical documents such as scientific works of literature and analytics of the entire study. Major players (IP owners) and underlying technological information are extracted. Major benefits of performing a landscape study are:

Unlike a landscape study, FTO search is only restricted to active patents (i.e., patents that are not expired/revoked). A time period of 20 years before the date of search is essentially considered. In most cases, FTO search is only restricted to the patent claims. In an FTO study, the key features of the product are compared with the claims of the existing relevant patent applications. It is advised to always conduct an FTO search in the early stages of R&D. There will always be room for changes, and you should end up with a product that is unique from the existing art.

3. My invention is ready and I want to file a patent on it, what search is most suitable? A Patentability search:

This search focuses majorly on the novelty criteria of an invention. A patentability search usually takes less amount of time and includes all types of publications (patent documents and non-patent documents). It is different from that of a landscape study as the latter does not primarily focus on the novelty criteria.

To get a patent for your invention, the three main criteria are novelty, non-obviousness, and industrial application. There are various types of applicants recognized by Rule 2 of the Indian Patent Rules, 2003. These different types of applicants enjoy various benefits during the patent prosecution in India like reduced fees for various actions etc. The types of applicants are as follows:

1. Natural persons: A real and living human being is called a natural person. No document is required to claim this applicant type.
2. Small entity: An applicant which is an entity can qualify as a small entity if the entity’s investment in plant & machinery or equipment does not exceed the limit of INR 500 million (INR 50 crore) and the annual turnover on the date of filing the application does not exceed the limit of INR 2.5 billion (INR 250 crore). An Indian entity can claim the status of a small entity by providing the MSME (Micro, Small & Medium Enterprise) certificate issued by Ministry of Micro, Small & Medium Enterprises.

A foreign entity may claim the status of a small entity by providing:

• An evidence document, for example, a certified copy of the financial statement or a certificate from a Chartered Accountant, showing that the investment in plant & machinery and the annual turnover is less than the aforementioned limits, and
• A declaration letter from the authorized signatory of the entity saying that the given information is true.

3. Startup: An Indian entity can claim the status of a startup by providing the startup certificate under the Startup India initiative.

A foreign entity can be considered a startup, if the entity has not crossed 10 years from the date of incorporation and its turnover is less than INR 1 billion(INR 100 crore) in any of the previous financial years. A foreign entity may claim the status of a startup by providing:

• An evidence document, for example, a certified copy of the financial statement or a certificate from a Chartered Accountant, showing that the annual turnover is less than the aforementioned limit,
• A declaration letter from the authorized signatory that the given information is true, and
• An incorporation/registration certificate.

4. Educational institution: Under the Indian Patent Rules, 2003, an educational institution means a university that is established by a Central/ Provincial/ State Act, including an educational institution that is recognized by the Central/ State Government or the Union territories.

A suitable document of eligibility is required to be submitted by the applicant.

5. Other than natural persons: If an applicant is not a natural person and does not qualify as a small entity or startup or an educational institution, then the applicant comes under this category. No documents are required to claim this applicant type and no additional benefit is mentioned in the Indian Patent Rules, for this type of applicant.

Q.1 What is FFL (Foreign Filing License)?
Ans. If an Indian resident wants to make a patent application outside India for an invention and he has not made a patent application for that invention in India within at least six weeks ago, then he must take a written permission from the Controller of Patents in the prescribed manner before making such patent application outside India.

Q.2 What if you do not obtain an FFL and file an application outside India anyway?
Ans. 1. You will be punished with imprisonment whose term can run up to 2 years or you may be punished with fine or both.

2. The corresponding Indian patent application related to that invention shall be considered abandoned. If it has already been granted, it shall be revoked for not obtaining the FFL.

Q.3 What is the prescribed way of obtaining an FFL?

Ans. 1. You need to make your application of request for making a patent application outside India, by filing Form 25 of the Patents Act, 1970. You need to mention the following details in your application:
a) Title of your application,

2. b) Name and addresses of the applicant(s),
3. c) Name and addresses of the assignee(s),
4. d) Name of countries where you wish to make a patent application outside India and
5. e) The reason(s) for making this application of request for obtaining an FFL.
6. You must also attach a brief description of your invention along with your application.
7. If you are filing your Form 25 via an authorized agent, you must also submit a duly signed and e-stamped power of attorney authorizing the agent.
8. After considering the subject matter of the invention, the Controller of Patents may issue an order letter approving or rejecting the request.

Q.4 What is the official fee and timeline related to process of obtaining an FFL?

Ans. There is no timeline fixed for obtaining the order letter from the Controller for your application. However, one may receive the order letter in 10 days, generally.

• If you are making an e-filing request, then the following official fee shall be applicable:

1. For natural person(s) or startup(s) or small entit(y)/(ies) or government educational institutions: INR 1600,
2. For other than natural persons: INR 8000.

• If you are making a physical filing, then the following official fee shall be applicable:

1. For natural person(s) or startup(s) or small entit(y)/(ies) or government educational institutions: INR 1750,
2. For other than natural persons: INR 8800.
